Overview

The accident insurance funds, in their capacity as employers' liability insurance associations, have regulated the obligations arising from occupational health and safety legislation regarding the handling of hazardous substances at universities as follows:

CLAKS Hazardous Substances Register

CLAKS is a central database that contains comprehensive information on chemicals and hazardous substances and can be used to create a hazardous substance register.

Responsibility Handling Hazardous Substances

In the state-run higher education sector, the persons responsible for fulfilling occupational health and safety obligations are, in addition to the bodies authorized to represent the states (usually the ministers of education and cultural affairs or science), the persons who perform management tasks in higher education institutions within the scope of their duties and powers. In accordance with the higher education legislation of the Länder, this includes in particular the university management (President, Rector or Chancellor), the management of the Faculties and Institutes and the university teachers.

Ausgangsstoffgesetz - Prävention des kriminellen Missbrauchs von Chemikalien

Die EU-Verordnung 2019/1148 über die „Vermarktung und Verwendung von Ausgangsstoffen für Explosivstoffe“ und deren Umsetzung in deutsches Recht durch das Ausgangsstoffgesetz (AusgStG) enthält Regelungen, um eine Bedrohung durch selbst hergestellte Explosivstoffe zu verhindern. Zu diesen, als Ausgangsstoffe bezeichnete Chemikalien, gehören z.B. Aceton, Ammoniumnitrat, Wasserstoffperoxid und Schwefelsäure sowie weitere, in Laboren übliche Substanzen. Für diese Stoffe gelten spezielle Bestimmungen für Einkauf, Lagerung, Verwendung, Bereitstellung und Entsorgung.

Welche Regelungen sind zu beachten?

  1. Besitzverbot für Privatpersonen bei besonders kritischen, sog. beschränkten Ausgangsstoffen
  2. Unterrichtung der Lieferkette / Endverbleibserklärung (Relevant für Einkauf, Weitergabe oder Entsorgung der betreffenden Chemikalien)
  3. Einrichten von Maßnahmen zum Erkennen verdächtiger Transaktionen, Abhandenkommen oder Diebstahl
  4. Meldepflicht für verdächtige Transaktionen, Abhandenkommen oder Diebstahl

MELDEPFLICHT INNERHALB VON 24 STUNDEN

Für den Fall des Abhandenkommens, Diebstahls oder bei verdächtigen Transaktionen besteht eine unverzügliche Meldepflicht innerhalb von 24 Stunden direkt an das Landeskriminalamt (LKA) sowie eine parallele Meldepflicht innerhalb der Universität.

Simple measures concept for hazardous substances (EMKG)

The BAuA's Simple Measures Concept for Hazardous Substances is an aid to action for the risk assessment of activities involving hazardous substances. It is aimed at those responsible in small and medium-sized enterprises (SMEs), safety specialists, company physicians and inter-company advisory services.

On the BAuA website, you will also find protection guides for common activities involving hazardous substances in chemical plants.

Hydrofluoric acid

Hydrofluoric acid is a strong contact poison. Increased caution is required when using it in the laboratory! The danger is increased by the fact that it is immediately absorbed by the skin. Hydrogen fluoride causes severe, deep burns of the skin, which initially appear deceptively harmless!

Emergency precaution Handling hydrofluoric acid

  • a substitute substance test and, if no substitution is possible, technical and personal protective measures!
  • Emergency plan and operating instructions must be prepared and regular instruction must be given to persons working with hydrofluoric acid.
  • Calcium gluconate gel must be kept on hand as emergency medication.
  • An eye shower and an emergency shower must be available in the immediate vicinity of the workplace.
