Voluntary Judicialization: The implicit policy-shaping role of the Swiss courts in social welfare
with Prof. Dr. Gesine Fuchs (Lucerne University of Applied Sciences and Arts)

In recent years, obligations and rules in Swiss social welfare have diffused from case law into laws, recommendations and legal texts. This is a specific form of diffusion and can be explained by institutional factors such as strong federalism and vague laws that require interpretation by the courts.

However, this diffusion took place without an open political debate and can therefore be described as voluntary judicialization. This entails normative, legal-sociological and democratic-theoretical problems. The article introduces the case law on social welfare, provides an overview of cantonal rulings in the area of social welfare employment programs and traces the effects of federal court rulings on cantonal laws and guidelines on social welfare.

Quality of life and life perspectives of families with disabled relatives in adulthood - results of the project "Families.strengths"

Around half of people with (intellectual) disabilities still live with their family, usually with their parents, even in old age. The lecture will present the initial results of the Families.strengths project, in which the main family carers were asked about their living situation.

The basis is an ongoing dissertation project in which biographical interviews were conducted with people who position themselves as men without their own negative experiences of racism

The pandemic has shed particular light on the legal allocation of responsibilities between the public health service, health and long-term care insurance funds, professional groups, services and institutions. Corona and labor market policy: From crisis policy to labor market policy reform

So far, the government's "bazooka" has had the COVID-19 crisis comparatively well under control. But does it offer any prospects for the future? The course could already be set for a fundamental reform of unemployment insurance. The prospect of employment insurance opens up new principles for the social protection of transitional risks in the course of life: breathing employment insurance, mixed and flexible financing of contributions and taxes, more personal autonomy and anchoring European elements in social risk management.

Professional and professional orientations are already difficult to identify in face-to-face communication with students, and this is even more true in the long-distance teaching of the summer semester 2020. The contribution attempts to reflect on these difficulties on the basis of current teaching experiences with empirical support.

Homeschooling - a (human) legal consideration

"Don't lose sight of disadvantaged pupils!" - This is how ministries of education and school authorities appeal to teachers in schools, or with similar pathos. However, it will hardly be possible to guarantee equal opportunities for all pupils in homeschooling with individual commitment from teachers alone. School closures and distance learning can exacerbate existing educational inequalities in the school system and existing structural disadvantages.

What can be derived from fundamental and human rights and the German anti-discrimination framework to shape homeschooling? Using the example of Berlin state law, the risks of discrimination posed by homeschooling elements will be discussed and how this can be addressed in the design and equipment of schools.
